INDIVIDUAL CANCELLATION - Individual Cancellation Policies will be noted on the website and are as follows:
If the reservation for an individual tour participant shall be cancelled by the client at least 30 days prior to departure, all monies paid with respect to said participant will be refunded. For cancellations by client on behalf of a participant within 29 - 15 days prior to departure of the tour, Western Leisure will retain 25% of the tour cost of the tour for such participant and the balance will be refunded. For cancellations by the client on behalf of a participant within 14 - 8 days prior to departure of tour, Western Leisure will retain 50% of the cost of the tour for such participant and the balance will be refunded. For cancellations by the client on behalf of a participant seven (7) or fewer days prior to departure of tour, Western Leisure will retain all monies paid for such participant and no refund will be made. ADJUSTMENT TO PRICE - Arrangements for hotels and other suppliers are subject to change. If any hotel or supplier should become unavailable, Western Leisure will use its best efforts to find a suitable alternative. If, as a result of the foregoing changes, or other unforeseen cost increases such as relating to fuel costs and/or government fees and taxes, including park fees, Western Leisure reserves the right to adjust the price accordingly.
SPECIAL NEEDS - The client acknowledges that it is exclusively responsible to identify and resolve the special medical equipment requirements of any individual tour participant and recognizes that the tour may involve activities that are beyond the physical capabilities of some persons. Western Leisure disclaims any obligation to provide individual assistance with walking, dining, or attending other personal matters. To the extent that any individual tour participant is disabled, the client acknowledges that it is exclusively liable to provide assistance to attend such needs as dressing, eating, moving about or participating in safety exercises.
ARBITRATION - Western Leisure and the client agree that any claim or dispute between them related to this agreement or otherwise shall be resolved by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any award of the arbitrator may be entered as a judgment in a court of competent jurisdiction.
GOVERNING LAW - This agreement shall be governed by the laws of the State of Utah.
LIABILITY OF WESTERN LEISURE - Western Leisure’s liability to the client or tour participants is strictly limited. Western Leisure is not responsible for direct, indirect, consequential or incidental damage, injury, loss, accident, delay or irregularity of any kind caused by any act or omission beyond its control. This includes without limitation, any negligent or willful act or failure to act of, or breach of contract by, any person supplying accommodation, transportation or other services pursuant to this agreement or any third party. All such parties are independent contractors. Western Leisure is the client’s agent and is not the agent for any party that provides accommodation, transportation or other services here under. Without limiting the foregoing, Western Leisure is not responsible for any loss or expense due to delays in changes or schedules, overbooking or downgrading of accommodations, defaults by third parties, mechanical failure of transportation equipment, or loss or damage to baggage. Western Leisure is not responsible for acts of God or force majeure events, sanitation problems, lack of medical care, sickness, weather conditions, strikes and other labor activities, acts of terrorism, or any other event beyond the direct control of Western Leisure. The right is reserved to decline or accept or retain any passenger as a member of the tour. In such instances, full or equitable amount will be refunded.
ACKNOWLEDGEMENT BY CLIENT - By making the required deposit and subsequent payments as required by this agreement, the client fully acknowledges that he/she understands the terms and conditions of this agreement and accepts the services of Western Leisure subject thereto.
